To Concerned Parties:

Updated to add text of Goldrushcam and meeting date in Mariposa.  If you live in the State of California and have or will have a septic system this will affect you.

Contact the state or your local Environmental Health department to voice your opinion.

SEPTIC SYSTEMS REGULATIONS
An agency of the State (Water Resources Board) has issued draft regulations for new and existing septic systems which may have a major impact.
A workshop for public input is scheduled in Mariposa as follows:
December 8, 2008  At 7 p.m.

All citizens with an interest in the construction and use of septic systems should consider attending the workshop or commenting on the draft regulation via writing.

This is an absolute crime as there are already sufficient rules and laws in place to stop the problems created by a malfunctioning septic system.

We do not need legislation that guarantees taxation and intrusion on private property rights by permitting agencies and guaranteed income for engineers, testing agencies and producers of high cost commercial solutions.

Those with vested interested have infiltrated government and are trying to insure massive amounts of income for themselves.

These groups are only trying to legislate themselves a job by use of the good ol' boy system where they create a major fictional problem and then offer a mandated outrageously expensive solution that will further reduce the affordability of housing to the working class.

Note that most of the agencies involved are of a parasitic nature and produce no income other than that which they take from the citizens by taxes, fees and mandated inspections, services and regulation.  Plumbers and septic service agencies are already called in when a genuine problem arises.

A recent permit fee I applied for was already over $21000 when mandatory school fees are included.  This was not for a development.  This was for one personal residence in Mariposa County....and now they want more???....even affecting properly functioning approved systems?

Ex-post facto law for profit?  What a good racket.

Raw sewage can be a factor in stream and groundwater pollution, but if the current rules and regulations are followed there is no problem.  It looks like this legislation could even close the Mariposa Sewage Treatment Facility.

This is an obvious greed induced industry and State money and power grab.  It must be stopped at all expense or the ability of the common man to build his own shelter will be greatly and unnecessarily increased in cost for the profit of a few.

Let's see to it that a larger burden is not legislated on the backs of the public.

The current financial meltdown will only continue to make building of our American Dream an impossible nightmare without the added burden of creating a fictional problem with a mandated solution.

The possibility of our children being able to build their own house on their own property is already beyond the grasp of most of them.

I am a licensed general contractor and water well driller. I keep an eye on government corruption issues such as this one.

Thanks to Goldrushcam for bringing this to my attention.  We must all rally together to stop it before the comment period is over February 9, 2009.

I have been fighting these criminals for years.  I got a water well tax/fee protest put on TV when it looked like there was no time to stop it according to the water well drillers association years ago. 

It stopped when the county phone lines jammed solid the next day.

We normal humans (those with less than $10 mil) are going to me legislated out of existance. We are dangerous poluters of the world. Ofcourse those that make the laws and their rich friends are angelic protectors of the planet and will save it from the rest of us.

I understand that the Elite will be presenting a proposal where any family with a combined  income of under $100,000 per year will be subject to having their rectum superglued shut.

"No colon cleansing for you low rent SOB's", one of them was heard to say. 

"Why should we hear about body bags and deaths," Barbara Bush said on ABC's "Good Morning America"  "Oh, I mean, it's not relevant. So why should I waste my beautiful mind on something like that?"   

Oh --- wait a minute --- That was a quote regarding deaths in the Iraq war.  Sorry.  gk





What gets me is that solids in a septic tank are a normal function, and if they go in an indiscriminately pump and break it up destroying the normal bacterial function in millions of tanks per year, they are likely to do more harm than good.  It takes a bit for the bacteria to reestablish themselves and get working properly again. 


True, they are being replenished one dump at a time but lets not fix something that is not broke just for profit.

Cholera type diseases are currently nearly non-existent with the current laws on septic systems.  This new legislation would be a blatant money grab if allowed to proceed.  Current cases are nearly always travel related.

This sufficient regulation by current laws is even admitted by the CDC .... who we can't always trust to have the interests of the people at heart either, but there it is....

Their report does not mention small septic systems as being a problem, but it does mention Sewage Treatment Operators as being one of their concerns refering to cities which commonly have large untreated sewage spills.

No mention of the already well managed individual septic treatment system.

Remember, the above quote is with the current standards.  Not the more restrictive standards proposed by the greedy money grubbing good ol' boys.

The only concern for the individual listed in the full report is travel to foreign countries with standards much lower than our current standards.

In nearly every case the problems can be traced back to raw sewage being released on the surface. Properly working septics do not pose a health risk. I know of several cases of RV'ers and trailer folk dumping their sewage into a creek or ditch. I never turned anyone in yet but I may start.

That's pretty disgusting.  There are plenty of RV dumps around or they can make one at their home.

We had one septic pumper in the Valley who used to spread it on a farm.  He finally got stopped from that.   

I am getting many positive responses on my septic riot. :)

After reading up on this .It looks more like a way for the parisites to check up on you every five years to see that you haven't been doing any illegal activities or building stuff with out permits.

This is my letter to the Governor, Senator, Assemblyman and the SWRCB, Glen I used some of your comment. I hope you all write too.

Dear Governor:


AB 885 is an absolute crime as there are already sufficient rules and laws in place to stop the problems created by a malfunctioning septic system. Ever phase of a septic system in the County of Mariposa is inspected by our building department and that includes percolation tests as well.

We do not need legislation that guarantees taxation and intrusion on private property by State agencies and guaranteed income for engineers, testing facilities and producers of high cost commercial solutions.

Those with a vested interest have infiltrated government and are trying to insure massive amounts of income for themselves on the backs of retired, low income and senior citizens.

These groups are only trying to legislate themselves a job by use of the good old boy system where they create fictional problems and then propose an outrageously expensive solution that will further reduce the affordability of housing for the retired, Senior Citizen and the working class.

Note that most of the agencies involved are of a parasitic nature and produce no income other than that which they take from the citizens by taxes, fees and mandated inspections, services and regulation.  Plumbers and septic service agencies are already called in when a genuine problem arises.

The State Water Resources Control board is a Government parasite that feeds on the taxes that it has caused to be collected to keep it in office. This parasite that is supposed to protect senior water rights has never settled my complaint and has tried to silence me by threatening to revoke my license.

Eleven ponds that were allowed to be constructed on the Humbug watershed illegally by the SWRCB hold back water that is should  go to the Spence and Bower ponds. The Spence and Bower ponds are the only ponds in the area that are large enough so a helicopter can pick up water for wildfires, and yet they do not get any water until the upstream ponds are full and overflow. So please tell me what the SWRCB is good for?

When funds for the SWRCB became limited and they might have to lay off some of their help or maybe go out of business they come up with the idea to TAX each pond $100.00 Dollars and 3 Cents per acre foot of water. Why not just charge one dollar for every acre foot in a pond or lake? Then a 30 acre foot pond would only pay $30.00 and not one hundred. Well for one thing, PG&E and Edison would have blown them out of the water with their high priced attorneys because they would have had to pay millions and with only a hundred bucks and a meager 3 cents per acre foot they could pass that on to their customers.

An article that appeared in the paper and written by J. W. Garlinghouse of the Soil Conservation Service so states. Water Essential: Water seem to be an essential to recreational development of the 11,500 farm ponds established on private lands in the state,  all include some type of recreation for the owner ,  his neighbors, or the public.  A Survey of  their recreational use either on a fee or non-fee basis shows:
4,600 are used for fishing,  2,700 are used for swimming,  3,000 allow seasonal waterfowl hunting, 700 permit boating,  and 1,200 have a variety of other uses including picnicking wildlife habitat and bird sanctuary.  This is but a portion of this article that appeared in the paper with a picture of our pond in 1960.

I am sure there have been several hundred or maybe even a thousand more ponds built since 1960 and the board gets at best $100 for each one. At the 11,500 pond level the Board would get one million one hundred and fifty thousand dollars! And that is not hay.

If the State Water Resources Control Board is so concerned with water safe conditions then WHY are they not working to stop the pollution of the Sacramento River? It is a known fact that Sacramento and Stockton dump some 350 million gallons of sewage into the Sacramento River daily. It is further known that the ammonia in the effluent is killing the fish in the river and the San Francisco Delta!

It is also a fact that the Los Angeles Hyperion sewage plant dumps over 450 million gallons of sewage into the Bay of Santa Monica everyday destroying fish and their habitat and has never heard from the SWRCB and you surely know the reason for that? Yep that's right no body but NO body messes with the County of Los Angeles!

Get into a boat and go out to where this monster pipe ends and you will see the water boiling up  brown with a disgusting medical stench. Any fish caught within miles of this filth will taste like the effluent smells and no where can the water board be found, because I have been there and seen this!

Oh I am sure some smart lab or company will find a bacillus coca mane flop-a doodle in my well water that has been in operation for over 60 years and has never caused anyone harm. And they will tell me I need to purchase their $20,000 dollar filter to be able to continue to use my water.

The SWRCB wants to make it's self more important, and of course the bigger you are the more money you can garner, and the more power you have and they want to do it on the backs of the Retired, Seniors and now that there is a recession the unemployed!

Thanks, Charlie, I'll pass this on to some who will forward it farther and am assuming you are granting permission for this to be spread far and wide.

I went to the Mariposa meeting and was surprised to see one of the good ol' boy lobbyists, government shills and likely inside profiteer who manufactures the New Septic systems that require real time (read full time) monitoring to be sure they are working.  He was the only one there who was all smiles and sitting back counting his money I assume.  Not to say that he doesn't have a decent product.  Let's just allow him to only step in when there is a real problem for his unit to fix and not just because he has a relative in office or has paid off the right people to get the law put into effect allowing him to be able to make a windfall profit.

It was made quite obvious to the citizens in attendance that the government representatives had little interest in hearing the problems of those opposed to their creating a problem and a solution for profits of the engineering, testing, inspecting and manufacturing sectors.

Their yawns and lack of concern were enough infuriate a lot of people.  Seems they are of the opinion they have it sewed up.  I think we need to monitor all of them for conflict of interest and their investments in the water and septic treatment companies.  I noticed that all of the studies were made by firms, engineers and government supported educational institutions that stand to profit from the taxes and income generated by this, yet another ripoff of the American working class citizen.

If they show up on my place they will be invoiced for a "$5000 per day or any portion thereof", land use fee, to help cover the cost of possible septic system improvements.  Email me if you want a link to the sign and listing of the Federal laws they are violating.


The fact that he was an insider was clearly shown by his remaining inside with the government officials after the meeting was over.  Even our health officials were aware that there are no problems here and the tiny incidental ones here pale in comparison to our states largest cities dumping raw sewage in the ocean.  Let them get the rafter out of their own eye before they worry about the gnat in ours.

Possibly we can catch them like the governor who was trying to sell Obama's seat.  Then they would not think they were so cute.

I have been a well driller for about 20 years and can assure you that the problems of the scope they are talking about are primarily generated by the sewage spewed by LA, SF, etc.  Other problems will be on a limited basis in limited areas.  Give a bureaucrat, engineer or scientist enough government money parasitically taken from the people and they will not only justify thier job by finding a problem and solution, but they will use the government funding against the very working class citizens they took it from.

The officials little joke of drinking effluent in our water was just that.  There are no major disease clusters in California indicating a problem with pathogens that are not already being dealt with under the current sufficiently safe laws..

I don't understand. Is this septic issue already a done deal? Why are they having town meetings about it if it is? I mean, it's should be pretty obvious to them that people don't want this. What was the purpose of the meeting - to make themselves feel better that people were able to voice their opinions, and then they'll go ahead and do what they want to?  ???

I think it was done long ago then postponed due to opposition ? and now they want to ram it down our throats after letting us scream.  I think the meeting was to tell us they have us by the short hair but there must be more.  I'm just making lots of noise in case it will do some good and trying to get others to look and yell at them too.

Maybe they will re-think if they think we will storm Sacramento?
