Education officials break down Stockton man's door

STOCKTON, CA - Kenneth Wright does not have a criminal record and he had no reason to believe a S.W.A.T team would be breaking down his door at 6 a.m. on Tuesday.

"I look out of my window and I see 15 police officers," Wright said.

Wright came downstairs in his boxer shorts as the officers team barged through his front door. Wright said an officer grabbed him by the neck and led him outside on his front lawn.

"He had his knee on my back and I had no idea why they were there," Wright said.

According to Wright, officers also woke his three young children ages 3, 7, and 11, and put them in a Stockton police patrol car with him. Officers then searched his house.

As it turned out, the person law enforcement was looking for was not there - Wright's estranged wife.

"They put me in handcuffs in that hot patrol car for six hours, traumatizing my kids," Wright said.

Wright said he later went to the mayor and Stockton Police Department, but the City of Stockton had nothing to do with Wright's search warrant.

The U.S. Department of Education issued the search and called in the S.W.A.T for his wife's defaulted student loans.

"They busted down my door for this," Wright said. "It wasn't even me."

According to the Department of Education's Office of the Inspector General, the case can't be discussed publicly until it is closed, but a spokesperson did confirm that the department did issue the search warrant at Wright's home.

The Office of the Inspector General has a law enforcement branch of federal agents that carry out search warrants and investigations.

Stockton Police Department said it was asked by federal agents to provide one officer and one patrol car just for a police presence when carrying out the search warrant.

Stockton police did not participate in breaking Wright's door, handcuffing him, or searching his home.

"All I want is an apology for me and my kids and for them to get me a new door," Wright said.

The Department of Education has a SWAT team?  They enforce defaulted student loans by kicking in doors and pointing guns at people?  debt is not a criminal offense, it is a civil one; what were they going to do with her even if she was home? 

At any rate, it certainly explains why they were buying 870 shotguns last year.  err, not just shotguns - 14" barrel class 3 weapons.

Wow!  Scary for lots of reasons.  Severe implications.  I just hope Citibank or American Express don't get any ideas.  On the other hand, it would be a good time to buy Home Depot stock low, cause there will be a whole lot of doors needing fixing.   ;D ;D

These kind of police warrant raid debacles happen fairly often. Wrong addresses or bad informants seem to be most common causes. The lawsuits that result are often quietly settled with little or no public notice.

First I've ever heard about by fed bill collectors. If i was that guy, I would be speaking to agency through an attorney.

This was not about unpaid loans,  this is a criminal investigation.  You can agrue about the agressiveness of the search, but the reason for it is not unpaid loans

Okay then fill us in..... What went down and why. 

Seems every report I have seen claims The U.S. Department of Education issued the search and called in the S.W.A.T for his wife's defaulted student loans.  Strange I did not know the U.S, Department of Education had authority to issue a search warrant.  Does that not have to come from a judge?  But wait it says.  "The U.S. Department of Education issued the search and called in the S.W.A.T".  Did they have a search warrant or not?  Who signed it and what was the evidence?  Did this case appear before a grand jury and if so what were their findings?

Oh my God you don't suppose the kids were being home schooled?

Short version

ARIZONA-Jose Guerena, a decorated Marine was shot and killed by a SWAT team in a raid gone wrong. The team was looking for a marijuana ring and gave no warning before entering Gerena's house. The Huffington Post reports:

As the SWAT team forced its way into his home, Guerena, a former Marine who served two tours of duty in Iraq, armed himself with his AR-15 rifle and told his wife and son to hide in a closet. As the officers entered, Guerena confronted them from the far end of a long, dark hallway. The police opened fire, releasing more than 70 rounds in about 7 seconds, at least 60 of which struck Guerena. He was pronounced dead a little over an hour later.  OOOPPS! Wrong address - dang bet we get scolded for this one....

The police state first said he shot first.... truth is gun was loaded but safety was on and never fired.  Why was no one allowed to come to his aid?  Not that anything could have been done.  After all there were only seventy rounds fired and sixty hitting him....

Exactly Ajax.  The feds were way out of control on this.  The warrant is a simple search warrant for documents for financial aid fraud.  A S.W.A.T team and hand cuffs on anyone is way beyond all protocol.  Detaining anyone, especially in cuffs while searching for W-2's and Fafsa forms? Especially with the fact that the person handcuffed wasn't even the target of the investigation. Insane. 9999 times out of 10000 this would have been done with a simple grand jury subpoena.  I hope he has a good lawyer.

BTW Ajax, if they take the position that she took the loans and no intention to pay them back, they could have construed that as financial aid fraud.  She filled out the form online - wire fraud.  She took the money, theft of government funds.  AKA, unpaid student loans.

On another note, they devoted this much in federal resources to this?  Wow.  It looks like they were trying to make a splash and it is backfiring.  There is no way 15 special agents had nothing better to do for the day.

The warrant seems to be in order.   Thanks, nice to know the Department of Education is doing their job.

Wonder why the FBI was not doing their job?  They must be busy.....  

Wonder why they did not just arrest her?

Oh she was not there.  After all she was his estranged wife.

Bet every one that knows her is wondering when their turn comes.....

Why did they think they needed a swat team? Was this woman known to be armed and dangerous? And why has the department of education been transformed into law enforcment? Wouldn't this be a job for the FBI?

A civil case brings a SWAT team to your door nowadays.  Eventually, they'll be wearing  Wells-Fargo logos on their sleeves.  Oh wait, that'd be too obvious.
